Is Online Poker Legal in Indiana?
For many, Indiana is a gambler’s dream. However, what you need to bear in mind is that despite having a number of regulated gambling options available, they do take a very strict approach to gambling that isn’t regulated. This means that if you are playing unregulated gambling in Indiana, or even running a game, then you could be in line for some pretty strict penalties. Let’s take a little look at the law in this state.
Firstly, it is worth mentioning that the legislation here is incredibly broad. So broad in fact that not only does it cover games of chance (what we normally see as gambling) but also games of skill, which isn’t necessarily gambling. In short, gambling in Indiana covers pretty much anything where money is at stake, all you need to do is place money on an outcome and you will have fallen foul of the law!
Gambling” means risking money or other property for gain, contingent in whole or in part upon lot, chance, or the operation of a gambling device
Now, Illinois, close by, doesn’t really target players when it comes to gambling. Indiana does. In fact, a number of players have been charged with offences for gambling in unregulated environments, so you are not safe! If you are running an illegal game, assisting with it or promoting it then you are subject to a felony charge. Indiana is very strict here, so you do need to watch out.
Indiana allows for a number of commercial operations in the state for gambling, which do cover almost anything that you could wish for. There is also horse racing and a state run lottery. You of course also have charitable gambling at your disposal if you wish.
Casinos and Live Poker
As mentioned previously, there are a number of commercial casinos in force throughout the state which means that a gambler is fully catered for. These do include poker options. You also have charitable options. However, there is no other situation in which live poker is allowed, in fact, even social gamers have fallen foul of the law with a number of them being arrested in recent years for being mere players. Regular raids are being carried out, and thus it is worth avoiding as you never know when you might get caught.
The law surrounding Online Poker is a tricky one in Indiana. They are one of a few states which expressly mentions online gambling. However, it only prohibits the running of a site which offers gambling options. There is nothing that mentions players. However, we can assume that it would be illegal to be a player in Indiana based on a few of the other laws that we have seen!
So, will it be legal any time soon? This is just as tricky to answer! There have been no proposals as of yet, but with the amount of regulated gambling options in Indiana already, it is probably fair to say that it will come at some point. However, as and when it will is anybody’s guess.
