Is Online Poker Legal in Nebraska?
In the past, Nebraska was well-known for its particularly tough stance on all forms of gambling. However in recent years, the legislation appears to have been updated a little which allows for some forms of regulated gambling, although those that gamble in an unregulated game are subject to some pretty tough penalties. Let’s take a little look.
The definition of gambling in Nebraska legislation reads as the following:
he or she bets something of value upon the outcome of a future event, which outcome is determined by an element of chance, or upon the outcome of a game, contest, or election, or conducts or participates in any bingo, lottery by the sale of pickle cards, lottery, raffle, gift enterprise, or other scheme 
Here, as only an ‘element of chance’ needs to be involved, it could also cover skill games where a bit of luck is also needed to win the game i.e. poker and the like. Both players and operators are of course treated differently in the eyes of the law, however, it is worth noting that the latter is subject to much stiffer penalties.
That being said, there have been few to no arrests made in Nebraska within recent years, which highlights that the authorities are not really looking to enforce this legislation (or that Nebraska doesn’t have many gamblers, which is highly unlikely!).
There are a number of tribal casinos in the state as well as a state operated lottery when it comes to regulated forms of gambling.
Casinos and Live Poker
Whilst there are casinos in Nebraska, operated by tribes, none of them offer the traditional casino games. They are mainly filled with gambling machines. In fact, from what I can tell, there is no poker in any of them, which means that it is highly unlikely that you will be able to play a regulated game of poker within the state of Nebraska.
It isn’t even allowed under charitable gambling! There is also no specific exception for social gambling under the law, which means that those who play the game in a social environment could also be subject to penalties if they are caught gambling.
However, it is worth noting the point that I mentioned at the start. There has been nobody arrested in recent years for unregulated gambling, so if you do play poker in a social environment then the authorities wouldn’t pay much attention, although you do need to bear in mind that it is illegal, so there is always the chance that they will!
Online Poker is not mentioned in the legislation, although based on the definitions above, it is unlikely that it would be legal. There is one thing to note in the legislation however, and that appears that it would be illegal to gamble outside of the state if a resident of Nebraska, which means you wouldn’t even be able to play in an online room being run in another state:
It shall be no defense to a prosecution under any provision of this article relating to gambling that the gambling is conducted outside this state and is not in violation of the laws of the jurisdiction in which it is conducted. 
It is unlikely that online gambling will be regulated in Nebraska any time soon as it would involve changes to the legislation, something which most certainly won’t be happening!
