Is Online Poker Legal in Oregon?
Oregon is located in a prime location right on the pacific coastline. Inactive landscapes dominate the landscape, with a beautiful mixture of forests and waterfalls thrown in for good measure. This really is the state to head to if you want to ‘get away’ from it all. One of the best places to visit for any person heading to the state is Crate Lake National Park, although many of the cities and towns dotted around the area also are fantastic. Oregon is unique in the legislation it has when it comes to gambling, and we will take a little look at those soon.
The legislation in Oregon is incredibly helpful as unlike some other states out there it actually gives us an idea of what could be defined as illegal gambling. Let’s take a little look at these two different sections:
“Gambling” means that a person stakes or risks something of value upon the outcome of a contest of chance or a future contingent event not under the control or influence of the person, upon an agreement or understanding that the person or someone else will receive something of value in the event of a certain outcome.
Section 167.117(6 )
“Contest of chance” means any contest, game, gaming scheme or gaming device in which the outcome depends in a material degree upon an element of chance, notwithstanding that skill of the contestants may also be a factor therein. 
So according to this law, anything which has an element of chance in Oregon could be defined as gambling and thus have a chance of being punished. The fines are different for both players and operators of gambling. If a player promotes the gambling then it is defined as them being an operator, and thus subject to the full force of the law, this includes up to five years in prison.
There are some legal forms of gambling in Oregon. This includes a state lottery and horse race betting. There are also a number of tribal casinos in the area. We will take a little look at social gambling laws soon.
Casinos and Live Poker
The only way in which you are going to be able to play live poker in Oregon is either via social poker nights as well as via tribal casinos, of which there are quite a few of them. There are no commercial casinos operating within Oregon.
Unlike some other states, there is special exclusion for social games in the law of Oregon which means they are not subject to the law.
(a) A game, other than a lottery, between players in a private home where no house player, house bank or house odds exist and there is no house income from the operation of the social game; and
(b) If authorized pursuant to ORS 167.121, a game, other than a lottery, between players in a private business, private club or place of public accommodation where no house player, house bank or house odds exist and there is no house income from the operation of the social game. 
Oregon is one of the few states in America which has specific laws related to gambling. Although this legislation is aimed at those that operate sites as opposed to gambling via these sites. Which means that it could potentially be legal if gambling on a site ‘out of state’
It is unlikely that the law relating to gambling in Oregon will change any time sooner, there has been no discussion on the matter and nobody seems to be mentioning it.
