Is Online Poker Legal in West Virginia?
Welcome to West Virginia, the best kept secret in the mountains. The state has it all for those that love the outdoors, country culture and of course gambling. Gambling is a popular pass time in the state with a number of tribal casinos and race tracks to choice from.
There are currently no laws against online poker in the state of West Virginia. The state is more gambling friendly than most, with Race tracks being the most popular form of gambling. Even though the state is open to games of chance they do not put up with un-regulated forms of gambling.
The law states: “Betting on games of chance; furnishing money or thing of value therefor; penalty. If any person at any place, public or private, bet or wage money or other thing of value on any game of chance, or shall knowingly furnish any money or other thing of value to any other person to bet or wage on any such game, he shall be guilty.”  It means that even private poker games at come could be considered illegal.
Casinos and Live Poker
There are a number of commercial non-tribal casinos and racetracks in the state. Many of them offer live poker. West Virginia also offers a state lottery and video lottery games. West Virginia’s openness to gambling has made them a prime candidate for legalizing online poker.
Currently there are no clear laws concerning playing or operating online poker. There has not been a push by the land based casinos in the state to legalize online poker, but the state government raises the point that online poker has the potential to raise tax revenue. It will not be the first time the state has looked to gambling to collect more taxes, they originally legalized horse racing in the state for this purpose.
There are a number of obstacles impeding the progress of legalizing and regulating online poker in West Virginia, the most notable is the state’s small population.
